General Conditions

  1. Quotation: A quotation not accepted within thirty (30) days is subject to review. All prices are based on material costs at the time of quotation.
  2. Orders: Orders regularly placed, oral or written, cannot be canceled except upon terms that will compensate Beneco against loss incurred in reliance on the order. Acceptance of orders is subject to credit approval and contingencies such as fire, water, strikes, theft, vandalism, acts of God, civil unrest and other causes beyond Beneco control.
  3. Experimental Work: Charges for experimental or preliminary work performed at customer’s request will be at Beneco current rates. This work cannot be used without Beneco written consent.
  4. Creative Work: Creative work, such as sketches, copy, dummies and all preparatory work developed and furnished by Beneco shall remain Beneco exclusive property and no use of same may be made, nor any ideas obtained there from may be used, except upon compensation to be determined by Beneco, and expressly identified and included in the selling price.
  5. Accuracy of Specifications: Quotations are based on the accuracy of the specifications provided. In Beneco discretion, the original quotation may be rendered void and  Beneco may re-quote a job at time of submission if copy, film, tapes, disks, or other input materials do not conform to the information and assumptions on which the original quotation was based.
  6. Preparatory Materials: Art work, type, plates, negatives, positives, tapes, disks and all other items supplied by Beneco remain Beneco exclusive property.
  7. Electronic Manuscript or Image: It is the customer’s responsibility to maintain a copy of the original file. Beneco is not responsible for accidental damage to media supplied by the customer or for the accuracy of furnished input or final output. Until digital input can be evaluated by Beneco, no claims or promises are made about Beneco ability to work with jobs submitted in digital format, and no liability is assumed for problems that may arise. Any additional translating, editing, or programming needed to utilize customer-supplied files will be charged at prevailing rates.
  8. Alterations: Alterations represent work performed in addition to the original specification. Such additional work shall be charged at current rates.
  9. Pre-Press Proofs: Pre-press proofs shall be submitted with original copy. Corrections are to be made on “master set” returned marked “O.K.” or “O.K. with corrections” and signed by customer. If revised proofs are desired, request must be made when proofs are returned. Beneco cannot be held responsible for errors under any or all of the following conditions: if the work is printed per customer’s O.K.; if changes are communicated orally; if customer has not ordered proofs; if the customer has failed to return proofs with indication of changes; or if the customer has instructed Beneco to proceed without submission of proofs.
  10. Press Proofs: Press proofs will not be furnished unless the customer expressly requests them and they have been expressly quoted in  Beneco quotation. A press sheet can be submitted for the customer’s approval as long as the customer is present at the press during make-ready. Charges for any press time lost or alterations or corrections made because of the customer’s delay or customer changes or corrections will be at Beneco current rates.
  11. Color Proofing: Because of differences in equipment, processing, proofing substrates, paper, inks, pigments, and other conditions between color proofing and production pressroom operations, a reasonable variation in color between color proofs and the completed job shall constitute acceptable delivery.
  12. Over-runs and Under-runs: Overruns or underruns not to exceed 10% on quantities ordered, or the percentage agreed upon, shall constitute acceptable delivery. Beneco will bill, and customer will pay, for actual quantity delivered within this tolerance. If customer requires guaranteed exact quantities, the percentage tolerance for over-runs will be 20%.
  13. Customer’s Property: Beneco will only maintain fire and extended coverage on property belonging to the customer while the property is in possession. Beneco liability for this property will not exceed the amount recoverable from the insurance. Additional insurance coverage may be obtained if it is requested in writing, and if the premium is paid to Beneco.
  14. Delivery: Unless otherwise specified, the price quoted is for a single shipment, without storage, F.O.B. Beneco platform. Proposals are based on continuous and uninterrupted delivery of complete order, unless specifications expressly state otherwise. Charges related to delivery of materials from customer to Beneco or from customer’s supplier to Beneco are not included in any quotations unless specified. Special priority pickup or delivery service will be provided at current rates upon customer’s request. Materials delivered from customer or its suppliers are verified with delivery ticket as to cartons, packages or items shown only. The accuracy of quantities indicated on such tickets will not  be verified and Beneco does not accept liability for shortage based on supplier’s tickets. Title for finished work shall pass to the customer upon delivery to carrier at shipping point or upon mailing of invoices for finished work, whichever occurs first.
  15. Production Schedules: Production schedules will be established and adhered to by customer and Beneco, provided that neither shall incur any liability or penalty for delays due to state of war, riot, civil disorder, fire, labor trouble, strikes, accident, energy failure, equipment breakdown, delays of suppliers or carriers, action of Government or civil authority and acts of God or other causes beyond the control of customer or Beneco. Where production schedules are not adhered to by the customer, final delivery date(s) will be in accordance with Beneco revised schedule.
  16. Customer Furnished Materials: Materials furnished by customers or their suppliers are verified by bills of lading. Beneco bears no responsibility for discrepancies between delivery tickets and actual counts. Customer-supplied paper must be delivered according to specifications furnished by Beneco. These specifications will include correct weight, thickness, pick resistance, and other technical requirements. Artwork, film, color specifications, special dies, tapes, disks, or other materials furnished by the customer must be usable by Beneco without alteration or repair. Items not meeting this requirement will be repaired by the customer or by  Beneco at Beneco  current rates.
  17. Outside Purchases: Unless otherwise agreed in writing, all outside purchases requested or authorized by the customer are chargeable.
